Legislative Priorities

End HOA Foreclosures

Assure homeowners in HOAs the right to vote, to run for office, and fair elections.

Establish a Priority of Payment schedule so that all payments by homeowners are applied first to past due assessments, second to current assessments, lastly to just claims as the homeowner directs so that due process is employed.

Amend the Texas Open Meetings and Open Records Acts so that HOAs are subject to these acts by removing applicability criteria three (3).

Mission

Texas Homeowners for HOA Reform, Inc. was founded to unite Texans statewide who:

  1. Believe that the fundamental rights of Texas homeowners living in mandatory HOAs have been diminished and outright denied by the current Texas Property Codes, and
  2. Support our objectives to introduce legislation that restores those rights.

We believe, without reservation, that:

  1. The Texas Homestead Act prevents homeowner associations from foreclosing on any Texas homeowner, and
  2. The Texas Property Codes should unequivocally support this basic homestead right.

Although not all HOA boards abuse their power, we believe

  1. That mandatory HOA boards far too often abusively assert the passage of Texas Property Codes 204 through 209 gives them unrestricted power to impose and collect dues, fees and fines from the homeowners within their associations.  
  2. In addition, these HOA boards far too often abusively assert the right to widely interpret deed restrictions leaving Texas homeowners with very little or no recourse in solving disputes with their HOA boards.

We believe that all Texans need to know the rights that are denied to a select group of Texas homeowners (living in HOAs) as well as the possible threat to every Texas homeowner if proposed legislation is allowed to become law.

We believe that Texas homeowners must be united in their effort to amend the current Texas Property Codes.

To this end the Texas Homeowners for HOA Reform, Inc. was established.  We intend to be diligent in our efforts until laws are created that protect basic homestead rights and guarantee a fair and democratic process in all Texas Homeowner Associations.
